Contesting an Election
Amendment
Section I:
Contestation Clause
This
bill is to change the set period for contestation of a campus-wide election
documented in the Constitution, Article V, Section IV, Part
2.
The
current reading is as follows:
“A
petition stating the reasons for opposition, accompanied by the signature of
at least five of those students voting in the election in question, shall be
presented to the Student Judiciary no later than seven days following the
last day of the election.”
The
wording will be changed to read:
“A
petition stating the reasons for opposition, accompanied by the signature of
at least five of those students voting in the election in question, shall be
presented to the Student Judiciary no later than the Wednesday of the next academic week following the election.”
Section II: Explanation
The current reading of the
constitution makes it extremely difficult to contest an election if the
following week falls on a break from classes (i.e. Spring Break, or an
elongated break due to Snow Days). Under the current reading, this must be
accompanied by the signatures of at least five of the students voting in the
election in question. As the campus is closed during a break from classes, it
is very difficult for a person wishing to contest the election to produce the
appropriate materials to the Chief Justice within the duration stated by the
current reading of the Section IV Constitution.
